TDIU: 100% Pay Below a 100% Rating

You do not need a 100 percent rating to be paid like you have one. If service-connected disabilities keep you from holding a real job, TDIU pays at the full 100 percent rate on a combined rating as low as 70, or a single condition at 60.

Total Disability based on Individual Unemployability, TDIU or IU, is the most valuable benefit most veterans have never heard of. It pays compensation at the 100 percent rate even though your combined schedular rating is below 100, on the theory that the rating schedule alone understates a disability that stops you from working. If your service-connected conditions have ended your career, this is the claim to understand.

The two doorways

Under 38 CFR 4.16(a), you meet the schedular threshold for TDIU one of two ways:

  • One disability rated at 60 percent or more, or
  • Two or more disabilities with a combined rating of 70 percent or more, and at least one of them rated 40 percent or more.

Before you conclude you fall short, note that 4.16(a) treats several groupings as a single disability for hitting the 60 or 40 percent figure: disabilities of one or both upper extremities or one or both lower extremities (including the bilateral factor), disabilities from a common etiology or a single accident, disabilities affecting a single body system such as orthopedic or neuropsychiatric, multiple injuries incurred in action, and multiple disabilities incurred as a prisoner of war. The test that actually decides it

Meeting the percentages is only the door. The decision turns on whether your service-connected disabilities leave you unable to secure or follow a substantially gainful occupation. Two points control that:

  • Substantially gainful vs. marginal. Section 4.16(a) says marginal employment is not substantially gainful. Marginal employment generally exists when your earned annual income does not exceed the Census Bureau’s poverty threshold for one person, a figure VA updates each year. Work in a protected environment, such as a family business or a sheltered setting, can also be treated as marginal.
  • It is about your disabilities, not the economy or your age. The question is whether the service-connected conditions themselves keep you from real work, not whether jobs are scarce where you live.

Extraschedular TDIU: below the numbers, still unemployable

What if your disabilities genuinely stop you from working but you do not meet the 60 or 70/40 percentages? Section 4.16(b) is the release valve. The rating board must refer such cases to the Director, Compensation Service, for extraschedular consideration, so you can still be awarded TDIU without hitting the schedular thresholds. You cannot claim 4.16(b) by the numbers, so the evidence of unemployability has to carry it.

The form and the evidence

Apply on VA Form 21-8940, the Veteran’s Application for Increased Compensation Based on Unemployability. It asks for your disabilities, your work and education history, and your earnings. VA will usually also send VA Form 21-4192 to your former employers to confirm why the work ended. What wins these claims is a clear record connecting the specific functional limits of your rated conditions to the demands of the jobs you can no longer do: medical evidence of severity, an honest work history, and, where helpful, a vocational assessment.

Where TDIU fits with everything else

TDIU is one of three roads to being paid at 100 percent, and unlike a schedular 100, it comes with the substantially-gainful-work limit above.
